The following document details the terms of use you agree to abide by when using products and services provided by Hennessy Catering Services ('the service', 'us' or 'the site'). It details a number of important detail of the user agreement between you('the user') and Hennessy Catering Services, so please take time to read through these terms and conditions of use. Your access and use of all our products and services including online services is subject to the terms of this document and you express your consent to abide by them by using our products and services and accessing and using hennessycatering.com.au.

Food Products, Service and Other Associated Services

• Guaranteed Guest Count
  

  You must submit the guaranteed number of guests (the “guest count”) for your Event to Hennessy Catering service coordinator no later than 72 hours prior to the Event. If the actual number of your guests at the time of the Event is larger than the guest count, you will be charged for the additional guests in attendance at the Event per guest rate stated in the Proposal. Hennessy Catering will not discount or reduce the contract price if the actual number of your guests at the time of the Event is less than the guest count you submit to Hennessy Catering.

• Cancellations and Refunds
  

  If you give Hennessy Catering a written notice of cancellation of this Catering Contract more than 15 days prior to the Event Date, Hennessy Catering will agree to cancel this Catering Contract at no charge and will refund any deposit paid. If you do not give Hennessy Catering a written notice of cancellation more than 15 days prior to your Event, you acknowledge that Hennessy Catering will suffer damages (such as the lost opportunity to book other events on the date of your Event, purchase of food and supplies, expenses of the services of Hennessy staff, etc.), and that the amount of actual damages caused by the late cancellation of this Catering Contract would be extremely difficult, if not impossible, to quantify. For the late cancellation of this Catering Contract (15 days or less prior to your Event), Hennessy Catering will retain the deposit as liquidated damages. In the event that you cancel this Catering Contract within 05 days of the Event Date, for whatever reason or cause (including without limitation Acts of God, weather, cancellation by location, etc.), you will remain obligated to pay the entire contract price, less the Event Fee, as liquidated damages to Hennessy Catering. You agree that these liquidated damages represent a fair and reasonable estimate of the losses and expenses Hennessy Catering would sustain as a result of late cancellation of this Catering Contract, given that actual damages are uncertain and not susceptible of exact measurement as of the date of this Catering Contract. Refunds on any accrued cost that falls under the event coordination services and rentals will be determined at time of cancellation.

• Menu Cost
  

  All menu prices are subject to change based on market prices of food ingredients. If there is a significant increase in any market price, Hennessy Catering will notify you of the contract price increase. If you do not agree to the new price, Hennessy Catering will propose substitute menu items to you in order for you to maintain the agreed upon menu price. If you do not agree to the proposed substitution, then Hennessy Catering may cancel this Catering Contract without further obligation and refund all monies paid.

• Food Policy
  

  For staffed Events, Hennessy Catering disposes of unused food and beverage items remaining upon the completion of each Event. If you or any of your guests request to take any of the remaining such food items, Hennessy Catering requires that any person removing food from an event sign a food release form. You agree to indemnify, defend and hold Hennessy Catering and its affiliates and their respective employees, representatives, agents and independent contractors harmless from any claims, injuries, losses or damages (including personal injury, wrongful death, and attorney’s fees) arising from or related to the post-Event consumption of leftover catered food and beverage items. Please note that NO CLIENTS WILL BE ALLOWED INTO THE KITCHEN AREA AT ANY TIME.

• Event Timeline and Staffing
  

  Each Event is unique and will require a different timeline, so we understand that there will be specific requirements discussed at the time of your booking, This timeline will be followed at all times during the event (for example: if the buffet is requested be opened at 1900-2130HRS then it will open at 1900HRS and close at 2130HRS) if any changes to be done on the function day the organiser will have to contact the function co-ordinator and only then an arrangement can be done. Event staffing is variable and will be determined at the time of booking (based on the guest count and Event Type). The Catering Coordinator will inform you of the staffing planned for your Event. Hennessy Catering pricing includes 2 hours for onsite, pre-Event set up, 3 hours for Event duration, and 2 hours for post-Event breakdown/cleanup. If your Event exceeds 3 hours in duration, additional staff time will be charged as a fee, in addition to the contract price.

• Damages and Liabilities
  

  Hennessey Catering Services shall not be responsible for the loss of or damage to any items provided, rented or furnished by you unless such loss or damage was caused solely by the gross negligence or wilful misconduct of Hennessy Catering. In any event, our liability for any claim arising under this Catering Contract (including, without limitation, our failure to provide the services, is limited to the contract price amount paid by you plus $500. You agree to indemnify, defend and hold Hennesey Catering Services and its affiliates and their respective employees, representatives, agents and independent contractors harmless from any claims, injuries, losses or damages (including personal injury, wrongful death, and attorney’s fees) arising from or related to the Event, unless such loss or damage was caused solely by the gross negligence or wilful misconduct of Hennessy Catering Services.

• Collections
  

  Any amount(s) remaining unpaid after the Event shall be overdue and accrue interest at a rate of 1.5% per month (unless otherwise agreed in writing by Hennessy Catering). In the event that Hennessy Catering takes any action (whether or not litigation is instituted) to collect unpaid amounts due to Hennessy Catering you agree to pay the reasonable costs of collection (including court costs and attorney’s fees).

Online Services

We strive to make the service as high as possible of standard, however we cannot guarantee this. Your use of the service is subject to this understanding. Furthermore, you may not use the site in any way that it is not meant to be used, which may cause the service to disrupt or to suffer damage. You may not use the service for or in any unlawful manner or purpose, or in encouragement of the same.

If any other third party exposes you for legal challenge due to an action of yours on the site, you agree to hold hennessycatering.com.au and its operators free or any harm, damages or fees payable which may arise from such a dispute.

A non-enforcement of these terms shall not be considered as a waiver, unless specifically expressed in writing. Whenever a portion of these terms is non-enforceable, it will not prevent the rest of the terms being valid. This document will not in any way prevent hennessycatering.com.au and its operators from their obligation to abide by any applicable state or federal laws.

We cannot guarantee the safety and/or security of the service, and its fitness for any purpose. This service is provided "as is" without any express or implied warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Furthermore, hennessycatering.com.au or its operators will not be liable to any user for any lost profits or other consequential, special, indirect, or incidental damages arising out of or in connection with this statement or the use of hennessycatering.com.au.

We reserve the right to add to, remove from and/or to alter these terms in part or in full at any time.
